General

These Terms of Use (“TOU”) constitute a binding agreement between CTIA Certification LLC (“CTIA Certification”) and you, the user (“You” or “Your”) and governs Your use of all portions of the website found at https://members.wisecertification.com and any and all associated material, functionality, content, or services contained therein (collectively, “Website”).  By visiting the Website and/or using the Website You agree to be bound by these TOU and the Privacy Policy found at https://wisecertification.docebosaas.com/learn/policy, incorporated herein by reference. These TOU apply to all users of the Website, whether You are a visitor or member.  If You do not unconditionally agree to all the terms and conditions of the TOU, You may not use the Website. Your use of or access to the Website constitutes Your acceptance of the TOU. Any rights not expressly granted herein are reserved.

 

Modification

CTIA Certification reserves the right to change the terms and conditions of the TOU from time to time, in our sole discretion. Such changes shall be effective immediately upon posting unless otherwise indicated. CTIA Certification has no other duty or obligation to inform You that changes have been made, regardless of the scope and importance of the changes. You are responsible for regularly reviewing these TOU. Your continued use of the Website after changes are posted to the Website constitutes Your acceptance of this TOU as modified by the posted changes. CTIA Certification may change, restrict access to, suspend, or discontinue the Website or any portion thereof, at any time.

 

Users

The services provided through the Website are only available to individuals who are at least eighteen (18) years old, or who are emancipated minors, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these TOU, and to abide by and comply with these TOU. In any case the Website and the Services are not intended for children under the age of thirteen (13). If You are under thirteen (13) years of age, please do not use this Website.

 

CTIA Certification may, at its sole discretion, refuse to offer the services to any person or entity, and may change its eligibility criteria at any time.

 

User Accounts

In order to access some features of the Website, You will have to create an account. You must submit a valid email address and select a password and user name during the registration process. You may never use another’s account without permission. When creating Your account, You must provide accurate and complete information. Failure to do so will constitute a breach of these TOU, which may result in immediate termination of Your account. Additionally, You must not (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than You without appropriate authorization; or (iii) use as a username a name that is otherwise offensive, vulgar or obscene. CTIA Certification reserves the right to refuse registration of or cancel a username in its sole discretion. You are solely responsible for activity that occurs on Your account and will be responsible for maintaining the confidentiality of Your account password. You may never use another user’s account. You agree to immediately notify CTIA Certification in writing of any unauthorized use of Your account, or other account-related security breach of which You are aware.  Such notices should be sent to support@wisecertification.com

 

Earnings & Income Disclaimer

All products and services available on the Website are for educational and informational purposes only.  Nothing herein, or any of the Website content or curriculum is a promise or guarantee of results or future earnings, and CTIA Certification does not offer any legal, medical, tax or other professional advice.

 

Code of Conduct

By enrolling in a CTIA Certification course or program, You agree that You will:

  • Complete all tests and assignments on Your own, unless collaboration on an assignment is explicitly permitted.
  • Maintain only one (1) user account and not let anyone else use Your username and/or password.
  • Not engage in any activity that would dishonestly improve Your results, or improve or hurt the results of others.
  • Not post answers to problems that are being used to assess user’s performance.

 

If You are found in violation of the TOU or Code of Conduct, You may be subject to one or more of the following actions:

  • Having any certificate earned in the course or program withheld or revoked;
  • Being unenrolled from a course or program;
  • Termination of Your use of the Website; or
  • Additional disciplinary actions at CTIA Certification’s sole discretion.

 

Code of Conduct violations will be determined at CTIA Certification’s sole discretion. You will be notified if a determination has been made that You have violated this Code of Conduct and You will be informed of the corresponding action to be taken as a result of the violation.

 

Certificates

CTIA Certification offers courses and programs in which users may enroll.  Upon satisfactory completion of such aforementioned courses or programs, CTIA Certification may issue a certificate to the user who has demonstrated satisfactory completion of the course or program requirement. The decision whether a certificate will be awarded to a user is solely within CTIA Certification’s discretion. 

 

Important Deadlines

For enrollment in a course or program offered on the Website, You have a period of sixty (60) days after You have made Your payment to download the course materials and complete all the course modules. If a user fails to enroll in the course after the sixty (60) day period following payment, the course will be deactivated and the user must reenroll. If a user fails to pass an exam on their first attempt, they have thirty (30) days to retake the exam. The Website provides annual certifications that must be renewed one (1) year after a user is certified.

 

Payments

The Website provides courses, programs, and products for a fee. If You choose to purchase a course,  program, or product from the Website, You agree to pay all applicable fees associated with the purchase of a product and/or upon Your enrollment in a course or program, before any product or service is provided. To process Your payment You will be required to supply certain information relevant to Your purchase including, without limitation, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.  When You submit Your payment, You represent and warrant that: (i) You have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information You supply are true, correct, and complete.

 

The processing of Your payment information is done by a third-party payment vendor, and You will be routed to a secure payment flow controlled by that vendor to complete the payment transaction. By submitting Your information, You grant CTIA Certification the right to provide Your name and billing address to third-parties subject to our Privacy Policy.  Once Your payment transaction is completed, a confirmation page will be displayed, and You will receive a confirmation email with Your name, order number, and the payment amount. Please retain this email for Your records as this information will be required if You seek a refund from CTIA Certification, as described below.

 

CTIA Certification reserves the right to refuse or cancel Your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, if fraud or an unauthorized or illegal transaction is suspected, or for any other reason within CTIA Certification’s sole discretion.

  • Coupon Codes: Coupon codes and other course entitlements are subject to expiration and any other conditions stated at the time of purchase.
  • Chargebacks: If a user initiates a chargeback, CTIA Certification may assess a $50.00 processing fee for each individual chargeback.
  • Interest: Any charges not paid when due are subject to interest at a rate equal to the lesser of: (i) one and one-half percent (1.5%) per month; or (ii) the maximum interest rate allowed by applicable law.
  • Collections Fee: In the event an account is submitted to a third-party collections service, a $30.00 processing fee may be assessed to the existing account balance. This fee is in addition to any other fees previously assessed on the account.

 

Refunds, Replacements, & Order Issues

All items courses and programs purchased on the Website are eligible for a refund for a period of twenty-four (24) hours  from the time of purchase or until any materials have been downloaded from the Website, whichever is sooner (“Refund Period”). To request a refund for a purchase that You made, send an email to support@wisecertification.com and include Your full name and order number in Your email request. Refunds will be credited through the billing method used and may take up to two (2) billing cycles to process. No refunds will be issued after the Refund Period for a purchase has passed.

 

Merchandise is not eligible for refunds and ALL MERCHANDISE SALES ARE FINAL. If You receive merchandise (i) that is damaged or defective and that You have not used, worn, or washed; or (ii) You receive the wrong merchandise; or (iii) You do not receive an item or items in Your order, please contact us at programs@wisecertification.com, so that we may correct the issue. When contacting us be sure to include the following: Order Number, Customer Name, Merchandise Description, and a brief description of the issue. We will respond to all emails within forty-eight (48) hours of receipt.

 

Use of Material; Non-Commercial Purpose

The contents of the Website are protected by copyright and other laws in both the United States and elsewhere. CTIA Certification authorizes You to view and download a single copy of any material on the Website solely for Your personal, noncommercial use. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of, use of, or access to the Website.

 

User Submission

The Website may provide registered users with the ability to upload, submit, disclose, distribute or otherwise post (hereafter, “posting”) content (including, without limitation, information, text, data, photographs and images) to the Website (hereinafter, “User Submission”). By doing so, You agree to grant CTIA Certification, its affiliates, and their assignees a worldwide, perpetual, irrevocable, non-exclusive, sublicensable, transferable, royalty-free, right to use, reproduce, display, perform, adapt, modify, distribute, translate, make derivative works of, incorporate into other works, add metadata associated with, and otherwise exploit such User Submission, including without limitation, any concepts, ideas, or know-how embodied therein, in any form and for any purpose, including without limitation promoting and redistributing part or all of the Website (and derivative works thereof), in any media format or technology now known or hereafter developed, in connection with the Website and CTIA Certification’s (and its successors’ and affiliates’) business.

 

Without limiting the foregoing and for the avoidance of doubt, by submitting a User Submission; You represent, warrant, and covenant that (i) You own or otherwise control all rights to such User Submission and that disclosure and use of such User Submission by CTIA Certification will not infringe or violate the rights of any third-party; (ii) You own or have secured all necessary licenses, rights, consents, and permissions for such User Submission and authorize CTIA Certification to make use of such User Submission in the manner contemplated by these TOU; (iii) that the content of each User Submission is truthful and accurate; (iv) use of the User Submission You supply does not violate these TOU and will not cause injury to any person or entity; (v) the holder of any rights, including moral rights in such User Submission, has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant the license stated above and acknowledge that such User Submissions may not be treated confidentially.

 

For avoidance of doubt, CTIA Certification’s use of any license granted by the submission of a User Submission is within CTIA Certification’s sole discretion.

 

Prohibited Use

As a condition of Your use of the Website, You represent and warrant to CTIA Certification that You will not use and will not permit others to use the Website in any manner that is prohibited by these TOU.  You also agree to not take any action or upload, download, post, submit, or otherwise distribute or facilitate distribution of any content using any communications service or other service available on or through the Website that:

  • Violates any applicable laws or regulations;
  • Is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, sexually explicit or profane, depicts nudity, unlawful activities, death or violence, or encourages conduct that could constitute a criminal offense;
  • Infringes on any patent, trademark, service mark, trade secret, copyright, right of privacy or publicity, or any other intellectual property rights of any other person or entity unless You own or control the rights thereto or have received all necessary consents;
  • Reproduces, re-transmits, or re-presents in any form, in whole or in part, any content, programming code, images, or graphics without express written permission of CTIA Certification;
  • Uses any meta tags or any other “hidden text” utilizing the names or trademarks of CTIA Certification;
  • Accesses, monitors, or copies any content or information of the Website using any “robot”, “spider”, “deep link”, “scraper” or other automated means, methodology, algorithm or device or any manual process for any purpose;
  • Contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data or other information of CTIA Certification or any third-party;
  • Impersonates any person or entity, including any employee or representative of CTIA Certification;
  • Imposes or may impose (as determined in CTIA Certification’s sole discretion) an unreasonable or disproportionately large strain on CTIA Certification’s infrastructure; (i) interferes or attempts to interfere with the proper working of the Website or any portions thereof; or (ii) bypasses any measures CTIA Certification may use to prevent or restrict access to the Website (or other accounts, computer systems, or networks connected to the Website)
  • Directly or indirectly deciphers, decompiles, disassembles, reverse engineers, or otherwise attempts to derive any source code or underlying ideas or algorithms of any part of the Website;
  • Modifies, translates, or otherwise creates derivative works of any part of the Website;
  • Copies, rents, leases, distributes, or otherwise transfers any or the rights that You receive hereunder; or
  • Otherwise violate any CTIA Certification policies or guidelines.

 

Ownership

The Website and all content, software, data, and information used to provide the Website, including text and images, method of display and presentation, source code, embedded routines and programs and other materials, as well as all copyrights, trademarks, patents, and other intellectual property rights therein or thereto, are owned and are proprietary to CTIA Certification, its affiliate and licensees and are protected by the copyright laws of the United States and other countries. The compilation of the content on the Website is the exclusive property of CTIA Certification and is protected by the copyright laws of the United States and other countries.

 

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Website, without the prior written permission of CTIA Certification. Except as expressly authorized in these TOU, You may not modify, distribute, reproduce, display, or use the Website or any elements thereof. All rights not expressly granted to You by us in these TOU are reserved to CTIA Certification and You acknowledge that You do not acquire any ownership rights by accessing or downloading copyrighted material from the Website as authorized hereunder.

 

Nothing in these TOU or its performance shall grant You any right, title, interest, or license in or to CTIA Certification’s names, logos, logotypes, trade dress, designs, or other trademarks.

 

Copyright Complaints

CTIA Certification respects the rights of all copyright holders and in this regard, we have adopted and implemented a policy that provides for the termination in appropriate circumstances of users of the Website who infringe on the rights of copyright holders.  If You believe in good-faith that anything on the Website infringes any copyright that You own or control, You may file a written notification of alleged copyright infringement with our designated agent that contains the following, as required by the Digital Millennium Copyright Act, 17 U.S.C. Section 512: 

  • Identification of the copyrighted work claimed to have been infringed;

CTIA Certification will notify You of any claim for which CTIA Certification seeks indemnification and will afford You the opportunity to participate in the defense of such claim, provided that Your participation will not be conducted in a manner prejudicial to CTIA Certification’s interests, as reasonably determined by CTIA Certification at its sole discretion.

 

Restricted Rights

The information that is downloaded from this Website for or on behalf of the Government of the United States of America and/or its agencies (“US Government”) is provided with Restricted Rights.
